mortgage, second A mortgage generally subject to the prior claims of a first mortgage. It may be created: in the case of freeholds, by charge by deed expressed to be by way of legal mortgage, or by demise for a term of years absolute; in the case of leaseholds, by charge by deed, or by sub-demise for term of years absolute. A second mortgagee should register the mortgage as a Class C land charge.
